Employer Terms & Conditions
EarlyO — Connecting Early Years Talent in Ireland Last updated: June 2026 Version 1.0
These Employer Terms supplement EarlyO's general Terms & Conditions and apply specifically to organisations registering as Employers on the platform. By registering as an Employer, you agree to both documents.
1. Employer Eligibility
To register as an Employer you must be:
- A legally operating childcare or early years setting in Ireland (Montessori school, crèche, daycare centre, afterschool provider, recruitment agency)
- Authorised to recruit staff for the roles you post
- Compliant with all applicable Irish childcare regulations, including Garda vetting requirements under the National Vetting Bureau (Children and Vulnerable Persons) Acts 2012–2016
We reserve the right to verify your organisation's legitimacy and to reject or remove Employer accounts that do not meet these criteria.
2. Job Adverts
2.1 You may only post adverts that:
- Are for genuine, current vacancies at your organisation (or on behalf of a client, if you are a recruitment agency)
- Accurately describe the role, location, contract type, and requirements
- Comply with the Employment Equality Acts 1998–2015 — you may not discriminate on grounds of gender, civil status, family status, age, disability, race, sexual orientation, religion, or membership of the Traveller community
- State Garda vetting requirements accurately — if a role requires vetting, this must be reflected in the advert
- Comply with the National Minimum Wage Act 2000 and any applicable sectoral employment orders
2.2 You may not post adverts that:
- Are for roles that do not exist or where there is no genuine hiring intention
- Require candidates to pay fees or purchase anything as a condition of employment
- Contain false salary information, misleading job titles, or inaccurate descriptions
- Advertise roles outside Ireland unless clearly stated
2.3 Advert approval
We reserve the right to review, reject, or remove adverts that breach these terms or applicable law. Adverts removed for breach are not eligible for refund.
3. Candidate Data — Your Obligations
When you view candidate profiles and match data on EarlyO, you act as a data processor in relation to that candidate data under GDPR, with EarlyO as the data controller.
You agree to:
- Use candidate data only for evaluating candidates for the specific vacancy they matched
- Not store, copy, or export candidate data outside EarlyO's platform except for the purpose of a specific active recruitment process
- Keep all candidate data strictly confidential and not share it with third parties without our written consent
- Delete any candidate data held off-platform within 30 days of the recruitment process concluding (hired or not progressed)
- Not contact candidates for any purpose unrelated to the specific vacancy
- Comply with GDPR in your handling of all candidate data
- Immediately notify EarlyO at privacy@earlyo.ie if you suffer a data breach involving candidate data obtained from our platform
You may not:
- Build databases or CRMs of candidates from data sourced through EarlyO
- Share candidate profiles (including screenshots) with third parties
- Use candidate data for any speculative or future recruitment without the candidate's fresh consent
4. Garda Vetting Data
Garda vetting status displayed on candidate profiles is self-reported by candidates. EarlyO does not verify vetting certificates and accepts no liability for the accuracy of this data.
As an employer, you are responsible for:
- Verifying Garda vetting status directly with candidates before making any offer
- Conducting your own Garda vetting through the National Vetting Bureau for all hires, as required by law
- Not making hiring decisions based solely on EarlyO's displayed vetting flag
5. Payment Terms
5.1 Pay-per-advert (€49 per advert)
- Payment is taken via Stripe before an advert goes live
- Each payment covers one advert for 30 days
- Adverts that expire can be renewed with a new payment
5.2 Monthly subscription (€149/month)
- Covers unlimited active adverts while the subscription is active
- Billed monthly in advance via Stripe
- Cancellation takes effect at the end of the current billing period; no pro-rata refunds
5.3 Refund policy
- Refunds for pay-per-advert: Available within 24 hours of publication if the advert has received zero candidate matches. Not available after 24 hours or if matches have been generated
- Refunds for subscriptions: We do not offer refunds for part-used subscription months. You may cancel at any time and will retain access until the period ends
- Adverts removed by EarlyO for breach of these terms are not eligible for refund

5.4 Price changes
We will give at least 30 days' notice of price changes. Changes take effect at your next renewal.
6. Data Processing Agreement
By accepting these Employer Terms, you enter into a Data Processing Agreement (DPA) with EarlyO for the processing of candidate personal data on the EarlyO platform. The key terms of this DPA are:
- Data controller: EarlyO (for candidate data on-platform)
- Data processor: You (Employer), for any candidate data you handle off-platform in connection with an EarlyO-sourced recruitment
- Purpose: Evaluating candidates for specific vacancies
- Data categories: Name, sector, location, skills, qualifications, experience, Garda vetting status
- Retention: You must delete off-platform candidate data within 30 days of process conclusion
- Sub-processors: You may not engage sub-processors with EarlyO candidate data without our written consent
- Audit rights: EarlyO may request confirmation of your data handling practices on reasonable notice

7. Employer Conduct
You agree not to:
- Attempt to identify, contact, or hire candidates who have dismissed your job match
- Share login credentials or allow access to your EarlyO account by unauthorised persons
- Make discriminatory hiring decisions based on any protected characteristic
- Misrepresent your organisation's status, size, or nature of work
8. Liability
EarlyO does not guarantee:
- That any specific candidate will be available, qualified, or willing to accept your role
- The accuracy of candidate-provided information (qualifications, vetting status)
- A minimum number of matches for any advert
EarlyO's liability to Employers is limited to the amount paid by the Employer in the preceding 12 months.
9. Termination
We may terminate your Employer account if you:
- Breach these terms (including misuse of candidate data)
- Fail to pay amounts due
- Are found to have posted fraudulent or unlawful adverts
Outstanding payment obligations survive termination.
10. Governing Law
These terms are governed by Irish law and subject to the exclusive jurisdiction of the Irish courts.
